1. Scope
These terms supplement the Agreement with PCGROUP, LLC / JBComm for the named AIMarket / OmniReach Service only where contracted and enabled. Master Terms definitions apply. Availability may vary by agreement, plan, tenant configuration, geography, and provider availability; no described capability is guaranteed released or included.
Where enabled, VCC may support inbound/outbound engagement, voice, email, SMS, and human/AI-assisted interaction. Channels and limits depend on the Agreement.
2. Calling, messaging, consent, and identity
Comply with applicable telemarketing, calling, texting, email, marketing, privacy, consent, do-not-call, opt-out, and identification requirements. You are responsible for content, recipients, timing, frequency, campaign purpose, sender/caller identity, and evidence of permission. Obtain applicable automated/AI contact permissions.
Rules depend on recipients, activities, jurisdictions, industry, and provider conditions. VCC is not an automatic compliance service. The AUP’s strict third-party-list condition continues.
3. Recording and monitoring
Recording, transcription, or monitoring must be enabled and lawful. Determine consent/notice requirements for all relevant participants/jurisdictions, obtain permissions, and set lawful use/retention. AI analysis does not remove these duties.
Communications and recordings remain Customer Data when processed for you under the DPA and permissions. Do not conduct unlawful surveillance or treat a setting as consent.
4. Abusive traffic and provider requirements
Do not generate fraudulent, abusive, illegal, or deceptive traffic or bypass agreed limits/provider restrictions. Relevant lawful identification, registration/approval, and carrier/provider requirements apply to contracted use. Master Terms/AUP permit restriction or suspension for risk/enforcement.
Connectivity or provider acceptance does not guarantee deliverability, answer rates, or compliance.
5. Telephone numbers and DID use
Telephone numbers/direct inward dialing (DID) are available only under the Agreement and applicable provider conditions. Assignment does not establish ownership, perpetual availability, portability, or transfer rights beyond contract/law. Use numbers for authorized lawful communications and accurate identity.
Assignment, porting, transfer, release, and discontinuance require authority and applicable procedures. No transfer-time or availability guarantee is created.
6. Emergency calling limitations
Do not rely on VCC as a substitute for emergency services or dedicated emergency calling unless a signed agreement expressly confirms supported capability and its conditions/limitations. Use appropriate alternative emergency contact means.
Any supported capability requires separate review of applicable location, notice, availability, and legal obligations. These terms assert neither emergency availability nor exemption from duties that actually apply.
7. Availability and dependencies
Communications may depend on third-party communications infrastructure, recipients, connectivity, and applicable provider requirements. Outages, maintenance, failures, changes, or restrictions can affect service. Charges and any signed support/service levels follow the Agreement; Master Terms availability/change protections remain.
